Empire says discussing PartyGaming settlement

LONDON - Internet casino and poker-room Empire Online said on Friday, it was in "advanced discussions" with sector leader PartyGaming about settling a legal dispute.

Empire sued former partner PartyGaming in December, after PartyGaming ringfenced its own poker players from those of "skin companies" like Empire Poker, hitting Empire's profits by around 10 percent.

Under the earlier partnership, Empire Poker players enjoyed competing against a large pool of competitors including PartyGaming's, but after the split they were confined to the smaller site with fewer players.

PartyGaming is the clear leader of the online poker sector, taking about half of the global revenues of around $2 billion (1.15 billion pounds).

Empire, the brainchild of Israeli entrepreneur Noam Lanir, claimed breach of contract and company sources said they had sued PartyGaming after it marketed to Empire's customers.

"Empire Online ... is in advanced discussions regarding settlement of the outstanding litigation claim with PartyGaming and assignment of the company's related skin activities to PartyGaming," it said in a statement.

Empire shares fell 1.5 percent to 127 pence by 10:08 a.m., while PartyGaming was down 0.4 percent to 128-1/2 pence.

"In the context of PartyGaming's market capitalisation, the settlement would be relatively small, so PartyGaming may just want to put this behind them," said analyst Robin Chhabra at Evolution Securities.

Last month, Empire confounded cynics by announcing it was confident of hitting a $37 million pretax profit target for 2006, despite the loss of the PartyGaming contract, and proving it had one of the best marketing teams in the industry.
